By submitting this application, the applicant requests recognition as a member or associate participant of the Jimenez Tribal Nation, a faith-based tribe and private membership association, operating as a private society, stewardship body, cultural and hereditary body, faith-based governance body, and private contractual association established by acknowledgment, consent, acceptance, and lawful agreement among its members and affiliated bodies.
The applicant understands and agrees that the Jimenez Tribal Nation operates as a private membership association and private society. Any membership, participation, access, privilege, recognition, service availability, or other relationship granted by the Nation is private, conditional, revocable, and subject at all times to the Nation’s governing authority, standards, agreements, constitution, bylaws, declarations, ministries, councils, stewardship structures, policies, procedures, and recognized administration.
Submission of this application constitutes a request for membership or related recognition only. No application, submission, communication, screening, review, or preliminary approval shall create a guaranteed right to membership, continued participation, protected access, service eligibility, property interest, public right, or irrevocable status of any kind. Membership or access may be denied, deferred, restricted, conditioned, suspended, revoked, changed, or terminated at any time, with or without notice, for any reason deemed sufficient by the Nation.
If recognized as a member, the applicant agrees to remain subject to the Nation’s constitution, bylaws, governing standards, rules, procedures, ministries, councils, declarations, stewardship structures, and recognized authorities, as they now exist or may later be amended, revised, expanded, clarified, or supplemented. The applicant acknowledges that the Nation’s governing authority retains the right to interpret, administer, enforce, and revise its standards, membership conditions, and protected access requirements.
For purposes of this agreement, the members body includes the Nation, its members, officers, trustees, councils, ministries, assemblies, affiliated bodies, enterprises, internal systems, protected records, public and non-public sites, off-site systems, service environments, communications, educational bodies, platforms, documents, intellectual property, administrative functions, and all associated protected affairs, whether on-site, off-site, physical, digital, internal, or external.
The applicant agrees that all non-public information concerning the Nation or its members body is confidential. This includes, without limitation, internal communications, member information, records, governance materials, proceedings, workflow details, protected service structures, policies, internal tools, site content not expressly made public, platform information, administrative data, operational methods, private directories, financial or service records, and other restricted content.
The applicant agrees not to disclose, copy, reproduce, summarize, republish, repost, distribute, export, transmit, download for redistribution, scrape, archive for outside use, adapt, repurpose, commercialize, or otherwise use confidential or non-public information without the Nation’s explicit prior written consent.
Members may publicly promote the lawful benefits, mission, and works of the Nation, but may not disclose confidential, non-public, restricted, internal, or protected information concerning the Nation, its members, or its members body.
The applicant acknowledges that the Nation, as a private faith-based tribe and private membership association, retains a legitimate privacy interest in its members, records, communications, proceedings, governance, internal affairs, platforms, and protected operations. The applicant agrees to respect that privacy and not to intrude upon, expose, interfere with, or improperly publicize the private affairs of the Nation or its members body.
The applicant expressly consents to the Nation’s use, review, processing, verification, storage, stewardship, internal transfer, assignment, application, and administration of submitted information for membership review, eligibility determination, records management, account administration, member communications, access control, service provisioning, support, compliance, security, governance, and the offering, granting, assigning, extending, or managing of additional Nation services, systems, records environments, apps, or protected member areas.
The applicant understands and agrees that submitted information may be used not only for the initial membership request, but also for membership administration and related Nation services now existing or later established.
The Nation shall not sell member information. Information provided by the applicant shall be protected to the fullest extent reasonably possible while in the custody, stewardship, care, possession, processing, or administration of the Nation and its members body. The applicant nevertheless understands that no system, communication channel, record environment, storage medium, or technical control can be represented as absolutely immune from all risk.
The applicant agrees not to misuse membership, member access, credentials, platforms, records, directories, sites, services, communications, service privileges, or other Nation resources. The applicant agrees not to use Nation systems or protected areas for unauthorized, deceptive, disruptive, harmful, abusive, unlawful, exploitative, invasive, or improper purposes.
The applicant agrees not to misrepresent identity, authority, affiliation, permissions, or membership standing, and not to assist or enable unauthorized access, disclosure, export, copying, duplication, or abuse by any other person.
The applicant understands that access to Nation services, records, portals, websites, member systems, communications environments, administrative systems, and related digital or physical resources is conditional, limited, and subject to monitoring, restriction, suspension, or withdrawal at the Nation’s discretion. The Nation may limit, disable, revoke, or change access privileges at any time to protect its members body, continuity, security, governance, records, property, or interests.
The applicant acknowledges that the Nation’s names, seals, insignia, marks, site content, service structures, page content, records formats, designs, layouts, systems, workflows, software, digital technologies, graphics, documents, and other proprietary or protected materials are owned, controlled, preserved, or stewarded by the Nation and its members body. The applicant agrees not to copy, adapt, reverse engineer, mirror, frame, republish, exploit, or misuse such materials without explicit written consent.
The applicant understands and agrees that membership or access may be denied, suspended, revoked, limited, changed, or terminated at any time, with or without prior notice, for any reason deemed sufficient by the Nation, including but not limited to breach of confidentiality, misuse of access, misrepresentation, noncompliance with Nation standards, harmful conduct, disruption, unauthorized disclosure, or conduct deemed adverse to the Nation’s interests, continuity, governance, privacy, property, records, security, services, or members body.
The applicant agrees to indemnify, defend, and hold harmless the Jimenez Tribal Nation, its members body, trustees, officers, councils, ministries, assemblies, affiliated bodies, enterprises, service bodies, administrators, successors, assigns, and recognized representatives from and against any claims, causes of action, liabilities, damages, losses, fines, penalties, costs, or expenses, including reasonable administrative and legal expenses, arising out of or related to the applicant’s breach of this agreement, breach of confidentiality, misuse of membership, misuse of access, misrepresentation, unauthorized disclosure, unlawful conduct, interference with Nation affairs, violation of Nation standards, or misuse of Nation records, systems, sites, services, platforms, or protected materials.
The applicant understands that the Nation does not guarantee continued access, continued service availability, uninterrupted platform availability, continued recognition, or any specific outcome from membership review, service access, or participation. The applicant agrees not to rely upon the existence of any temporary, conditional, or discretionary access as creating a permanent right or guarantee.
The applicant agrees that the confidentiality, privacy, non-disclosure, misuse, intellectual property, protection, indemnification, and related obligations in this agreement survive denial, suspension, revocation, termination, expiration, resignation, abandonment, or other end of membership or access status.
The applicant acknowledges and agrees that any typed name, digital signature, checkbox acknowledgment, electronically submitted form, or other electronic act of assent provided through this application constitutes the applicant’s valid acknowledgment and agreement. The applicant further agrees that the digital electronic signature provided through the application shall be treated as the equivalent of a handwritten signature for purposes of membership request, consent, acknowledgment, agreement, and recordkeeping.
The applicant declares under penalty of perjury under the laws of the United States of America that the information provided in the membership application is true, correct, and submitted in good faith to the best of the applicant’s knowledge.
By submitting the application, the applicant affirms that they have read and understand the Membership Agreement, Terms of Use, Privacy Policy, and applicable disclaimers, and agree to remain subject to the Nation’s governing standards as a condition of any membership or access that may be granted.
